Beard Photo Contest Official Rules
Prize(s): One (1) winner will receive a twenty-five ($25) gift certificate to Baesler’s Market, a twenty-five dollar ($25) gift card to Cheddar’s in Terre Haute, a twenty-five dollar ($25) gift certificate to Look Good Feel Good Barbershop, and a forty-five ($45) massage certificate from Wabash Valley Massage. The total approximate retail value of the prize package is $120.00. Certain terms, conditions, or restrictions may apply to the gift certificates.
Eligibility: No purchase necessary to enter or win. The “Beard Photo Contest Official Rules” (the “Contest”) is open to legal U.S. residents within WAWV/WTWO’s viewing area who are 18 years of age or older. Current and former employees of Look Good Feel Good Barbershop, Nexstar Broadcasting, Inc., Mission Broadcasting, Inc., WTWO, WAWV and mywabashvalley.com (collectively the “Sponsors” of this Contest), the other television and radio stations or multichannel video programming distributors in the Terre Haute, IN market, the respective affiliates, subsidiaries, agents, advertising or promotions agencies (if any) of all of the foregoing, and members of the immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or persons living in the same household (whether or not related) of all the foregoing are not eligible to enter or win. contest or sweepstakes only once every sixty (60) days. Participants are eligible to win a prize(s) valued at $600.00 or more only once every six (6) months. Only one (1) winner per household is permitted in any contest or sweepstakes.
This Contest is subject to all federal, state and local regulations and laws and is void where taxed, restricted or otherwise prohibited. By entering, participants agree to abide by these Official Rules and the decisions of the Sponsors, which will be final and not subject to appeal.
The Contest is open to individuals only. Corporations, associations or other groups may not participate in the Contest.
Entry and Award:
1. To enter, submit your favorite photo of your beard to the contest page on
www.mywabashvalley.com
. This Contest will begin at 8:00 a.m. ET on June 15, 2015, and end at 4:00 p.m. ET on July 14, 2015 (the “Contest Period”). Photo submission begins at 8:00 a.m. ET on June 15, 2015 and ends on at 5:00 p.m. ET on June 26, 2015. Only one (1) photo submission per person will be accepted. The voting period will begin at 8:00 a.m. ET on June 29, 2015 and end at 5:00 p.m. ET on July 13, 2015 the (“Voting Period”). Photos must be in JPG format(s). 2. If the photo is deemed inappropriate or does not comply with these rules or the restrictions below (as determined by the Sponsors in their sole discretion), it will be disqualified. By submitting a photo, each participant represents and warrants that he/she and any persons appearing in the photo, or who are identifiable in the photo, consent to the submission and use of the photo in the Contest and to its use as otherwise set forth herein. The participants give WAWV, WTWO, and the other Sponsors all rights to the photo submitted, including but not limited to the right to broadcast, publish, distribute, stream, and/or display the photo in any media whatsoever, in perpetuity, without further payment or authorization from the participant. To submit a photo online and to vote, you must be a registered user on www.mywabashvalley.com. In order to register, users must submit their name, phone number, address, birth date and e-mail address. Only one (1) vote per person, per day. Each participant is allowed to vote for their own photo once on each day of the Voting Period. Sponsors reserve the right to determine, in their sole discretion, if one person is submitting multiple votes per day, and to disqualify the votes of any such person.
3. One (1) winner will be determined by the entry with the most votes as of 4:00 p.m. ET on July 13, 2015. The winner will be announced at approximately 4:00 p.m. on July 14, 2015 on the contest page located at
www.mywabashvalley.com
and on Good Day Live on WTWO-TV. The winner will also be notified by a phone call and/or email. Broadcasts may be subject to changes and/or pre-emptions.
4. The odds of winning will depend on the number of eligible entries received and the number of votes cast for the submission(s).
5. In order to claim the prize(s)(s), the winner must appear in person at the WTWO/WAWV station during regular business hours, from M-F, 8:00am – 5:00pm, no later than July 31, 2015 (the “Prize(s) Claim Date”), to complete all required waivers and releases before the prize(s) will be awarded. Failure to respond to WTWO/WAWV’s communications or failure to claim the prize(s) by date will result in forfeiture of the prize(s). The winner will be required to sign an affidavit of eligibility and a publicity and liability release before receiving their prize(s). Any objection to or failure to sign the required releases and/or waivers will result in forfeiture of the prize(s). No prize(s) will be mailed under any circumstances.
6. Photo submitted by the entrants/participants may not contain, as determined by the Sponsor in its sole discretion, any content that:
Photos must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the photo contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties (e.g., photograph was taken by someone other than entrant), the entrant is responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, permission from the photographer to use the photo and name and likeness permissions from any person (or, if a minor, his/her parent or legal guardian) who appears in or is identifiable in the entry. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof will render entry null and void.
General Rules:
Sponsors may substitute prizes for prizes of like value in Sponsors’ sole discretion. Winners may not substitute prizes or redeem them for cash. Prizes may not be assigned or transferred to any other party.
Each winner is responsible for any taxes resulting from their acceptance of any prize(s) associated with this Contest. Winners may receive a W-9 or an IRS Form 1099 or equivalent from Sponsors. Winner(s) are required to fill out any tax forms requested by the Sponsors in order to receive their prize(s). All expenses on receipt and use of prize(s) are the sole responsibility of the winner.
Failure to comply with these Official Rules may result in a participant’s disqualification, at the sole discretion of Sponsors. If it is determined that the first winner is ineligible, declines the prize(s) or fails to claim the prize(s) by the Prize Claim Date, the prize(s) may be awarded by the Sponsors (in their sole discretion) to an alternate winner selected from the submission with the second most number of votes . If it is determined that the second alternate winner is ineligible, declines the prize(s) or fails to claim the prize(s), the prize(s) will not be awarded. Failure of a participant to adhere to any of the terms and conditions outlined herein will result in a forfeiture of the prize(s).
Sponsors reserve the right to discontinue the participation privileges of any participant (and void his/her entry) who engages in any fraudulent activity, inappropriate behavior to gain an unfair advantage, or uses this Sweepstakes in a manner inconsistent with these Official Rules or in violation of any federal, state, local laws, statutes or ordinances or with the intent to annoy, harm or abuse the Sponsors, their representatives or any other participant. In addition to discontinuance of participation privileges, Sponsors have the right to take appropriate administrative and/or legal action, including criminal prosecution, as they deem necessary in their sole discretion.
Sponsors are not responsible for technical or computer failures, errors or data loss of any kind, lost or unavailable internet or SMS connections, failed, incomplete, garbled or deleted computer or network transmissions, inability to access any website, cellular or online service, acts or omissions of Facebook, any disconnection or loss of call, any other error or malfunction, late, lost, illegible or misdirected entries, or for printing errors in any advertisement, entry form or these Official Rules.
Entry materials that have been tampered with or altered are void. If the Sponsors determine, in their sole discretion, that there is any suspected or actual electronic tampering with this Contest or if technical difficulties (e.g. infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors) which corrupt, compromise, or affect the administration, security, fairness, integrity of this Contest, the Sponsors reserve the right to void the entries at issue and/or terminate this Contest. If this Contest is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at http://www.mywabashvalley.com.
The winner (i) except where legally prohibited, by acceptance of the prize(s) grant permission (and agrees to confirm such agreement in writing) for Sponsors and its designees to use his/her name, entry material (including their photo submission), voice and/or likeness and prize(s) information for advertising, trade and promotional purposes without further compensation, at any times or time, in all media now known or hereafter discovered worldwide and on the Internet and/or World Wide Web without notice or review or approval; (ii) will be required to execute and return a release and wavier of liability; and (iii) will be required to provide their social security number and current government-issued photo identification reasonably satisfactory to Sponsors.
Sponsors disclaim all liabilities to the winners with respect to use of their photo submission and prize(s). Participants agree that Sponsors and their affiliated companies, and advertising and promotion agencies, and each of their respective officers, directors, employees, representatives, licensees, assignees and agents (collectively, the “Released Parties”) will have no liability whatsoever for, and are released and shall be held harmless by participants from and against any liability, for any injuries, losses or damages of any kind, to persons, including death, or property resulting in whole or in part, directly or indirectly, from (1) the publication, broadcast, display, or distribution of their photo submission, (2) acceptance, possession, misuse or use of any prize(s); and/or (3) any participation in this Sweepstakes or in any Sweepstakes-related activity.
Released Parties are not responsible for typographical, printing or other errors or problems relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the administration of this Contest, the processing of entries, the selection or announcement of the winners or in any Contest-related materials.
Sponsors reserve the right to change these Official Rules at any time.
Copies of these Official Rules or a winners’ list may be obtained at WTWO/WAWV studios during regular business hours, at mywabashvalley.com or by mailing a written request along with a self-addressed stamped envelope to “Beard Photo Contest Official Rules”, c/o WTWO/WAWV, 10849 N. US Highway 41, Farmersburg, IN 47850. Requests for copies must be received within thirty (30) days of the end of this Contest.
