Sweetest Kiss Photo Contest
Prize: One (1) winner will receive a fifty dollar ($50) gift certificate to Willows Gift & Home, a fifty dollar ($50) gift certificate to The Saratoga Restaurant, a dozen roses from Spark’s Floral Company (approximate value: $60), and an overnight stay at the Holiday Inn Express in Plainfield, Indiana (approximate value: $250). The total approximate retail value of the prize package is $410. Certain restrictions may apply to gift certificates and travel NOT included.
Eligibility: No purchase necessary to enter or win. The “Sweetest Kiss Photo Contest” (the “Contest”) is open to U.S. residents, 21 years of age or older. Current and former employees of Willow Gift & Home, The Saratoga Restaurant, Spark’s Floral Company, Holiday Inn & Express in Plainfield, Indiana, Nexstar Broadcasting, Inc., and Mission Broadcasting, Inc. (Willow Gift & Home, The Saratoga Restaurant, Spark’s Floral Company, Holiday Inn & Express of Plainfield, Indiana, Nexstar, Mission, WTWO, WAWV and mywabashvalley.com are collectively the “Sponsors” of this Contest), other television and radio stations or multichannel video programming distributors in the Terre Haute market, the respective affiliates, subsidiaries, agents, advertising or promotions agencies (if any) of all of the foregoing, and members of the immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or persons living in the same household (whether or not related) of all the foregoing are not eligible to enter or win. Participants must legally reside in the following Illinois counties: Clark, Crawford, Cumberland, Edgar, Jasper, Lawrence, and Richland; or the following Indiana counties: Clay, Daviess, Greene, Knox, Martin, Parke, Sullivan, Vermillion, and Vigo. Participants are eligible to win a WTWO, WAWV or mywabashvalley.com contest or sweepstakes only once every sixty (60) days. Participants are eligible to win a prize valued at $600.00 or more only once every six (6) months. Only one (1) winner per household is permitted in any contest or sweepstakes.
This Contest is subject to all federal, state and local regulations and laws and is void where taxed, restricted or otherwise prohibited. By entering, participants agree to abide by these Official Rules and the decisions of the Sponsors, which will be final and not subject to appeal.
The Contest is open to individuals only. Corporations, associations or other groups may not participate in the Contest.
By entering this Contest, participants acknowledge that this Contest is in no way sponsored, endorsed or administered by, or associated with Facebook. Participants agree that Facebook will have no liability whatsoever for, and is released and shall be held harmless by participants from and against any and all liability for any injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly from participation in this Contest. Participants agree to Facebook’s Terms of Use Agreement and to the use of their personal information as described in the Privacy Policy located at http://facebook.com, as well as the use of their personal information and photo as described in the Privacy Policy located at www.mywabashvalley.com.
Entry and Award:
1. This Contest will begin at 8:00 a.m. ET on Monday, February 2, 2015, and end at 4:00 p.m. ET on Friday, February 27, 2015 (the “Contest Period”). Photo submission will begin at 8:00 a.m. ET on Monday, February 2, 2015 and will end at 5:00 p.m. ET on Friday, February 20, 2015. The voting period will begin at 12:00 a.m. ET on Saturday, February 21, 2015, and will end at 5:00 p.m ET on Thursday, February 26, 2015 (the “Voting Period”). Only one (1) vote per person, per day. To submit a picture online and to vote, you must be a register user on www.mywabashvalley.com.
2. Participants may fill out the entry form and submit their favorite sweetest kiss photo on the NBC 2 WTWO Facebook page located at www.facebook.com/WTWOTV. Alternative Entry Method: Participants may fill out the entry form and submit their favorite sweetest kiss photo on the Contest page located at www.mywabashvalley.com.
3. Each entrant may submit only (1) photo either via NBC 2 WTWO Facebook page or the Contest page at www.mywabashvalley.com.
4. The entrant to receive the highest number of eligible votes during the Voting Period wins the prize. The winner will be posted on the NBC 2 WTWO Facebook page, and on www.mywabashvalley.com and will also be notified by a phone call and/or email.
Photograph Restrictions - Photographs may not contain, as determined by the Sponsors in their sole discretion, any content that
•is obscene, offensive, sexually explicit, suggestive, violent, profane, pornographic or derogatory of any ethnic, racial, gender, religious, professional or age group; endorses any form of hate or hate group; contains nudity;
•promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
•contains products or trademarks of any Sponsor competitor;
•defames, misrepresents or contains disparaging remarks about any person or company;
•contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, to the extent permission is necessary; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
•contains copyrighted materials owned by others (including, without limitation, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission, to the extent permission is necessary;
•contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission, to the extent permission is necessary;
•contains look-alikes of celebrities or other public or private figures, living or dead;
•communicates messages or images inconsistent with the positive images and/or good will to which Sponsors wish to associate; and/or
•violates any law or regulation.
Photographs must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the photograph contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties (e.g., photograph was taken by someone other than entrant), the entrant is responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Sponsors in the manner set forth in these Official Rules, including, without limitation, permission from the photographer to use the photograph and name and likeness permissions from any person (or, if a minor, his/her parent or legal guardian) who appears in or is identifiable in the entry. Sponsors reserve the right to request proof of these permissions in a form acceptable to Sponsors from any entrant at any time. Failure to provide such proof will render an entry null and void. By submitting an entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the photograph consent to the submission and use of the photograph in the Contest and to its use as otherwise set forth herein.
The winner must appear in person at the WTWO/WAWV station during regular business hours no later than March 27, 2015 (the “Prize Claim Date”), to complete all required waivers and releases before the prize will be awarded. Any objection to or failure to sign the required releases will result in forfeiture of the prize. No prizes will be mailed under any circumstances.
The prize includes only the specifically enumerated items listed in the “Prize” section above. The winner is solely responsible for the payment of all federal, state and local taxes with respect to their prize.
General Rules:
Sponsors may substitute prizes for prizes of like value in Sponsors’ sole discretion. Winner may not substitute prizes or redeem them for cash. Prizes may not be assigned or transferred to any other party.
Failure of a participant to adhere to any of the terms and conditions outlined herein will result in a forfeiture of the prize.
Winner is responsible for any taxes resulting from their acceptance of any prize associated with this Contest. Winner may receive an IRS Form 1099 or equivalent from Sponsors. All expenses on receipt and use of a prize are the sole responsibility of the winner.
Failure to comply with these Official Rules may result in a participant’s disqualification, at the sole discretion of Sponsors. If it is determined that a winner is ineligible, declines the prize or fails to claim the prize by the Prize Claim Date, the prize will be awarded to the entrant with the second highest number of eligible votes. If it is determined that the winner with the second highest number of eligible votes is ineligible, declines the prize or fails to claim the prize in a timely manner, the prize will be awarded to the entrant with the third highest number of eligible votes. If it is determined that the entrant with the third highest number of eligible votes is ineligible, declines the prize or fails to claim the prize, the prize will not be awarded.
Sponsors reserve the right to discontinue the participation privileges of any entrant (and void his/her entry) who engages in any fraudulent activity, inappropriate behavior to gain an unfair advantage, or uses this Contest in a manner inconsistent with these Official Rules or in violation of any federal, state, local laws, statutes or ordinances or with the intent to annoy, harm or abuse the Sponsors, their representatives or any other participant. In addition to discontinuance of participation privileges, Sponsors have the right to take appropriate administrative and/or legal action, including criminal prosecution, as they deem necessary in their sole discretion.
Sponsors are not responsible for technical or computer failures, errors or data loss of any kind, lost or unavailable internet or SMS connections, failed, incomplete, garbled or deleted computer or network transmissions, inability to access any website, cellular or online service, acts or omissions of Facebook, any disconnection or loss of call, any other error or malfunction, late, lost, illegible or misdirected entries, or for printing errors in any advertisement, entry form or these Official Rules.
Entry materials that have been tampered with or altered are void. If the Sponsors determine, in their sole discretion, that there is any suspected or actual electronic tampering with this Contest or if technical difficulties compromise the integrity of this Contest, the Sponsors reserve the right to void the entries at issue and/or terminate this Contest and conduct a random drawing to award the prizes among all eligible entries received as of the termination date. If this Contest is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at http://www.mywabashvalley.com. If, for any reason, this Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend this Contest. Sponsors reserve the right to disqualify any entrant that tampers with the operation of this Contest or the Facebook site or violates the Official Rules of this Contest.
The winner (i) except where legally prohibited, by acceptance of the prize grants permission (and agrees to confirm such agreement in writing) for Sponsors and its designees to use his/her name, photo, entry material, voice and/or likeness and prize information for advertising, trade and promotional purposes without further compensation, at any times or time, in all media now known or hereafter discovered worldwide and on the Internet and/or World Wide Web without notice or review or approval; (ii) will be required to execute and return a release and wavier of liability; and (iii) will be required to provide their social security number and current government-issued photo identification reasonably satisfactory to Sponsors. If a winner refuses or does not complete and fully-execute the release, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, or if prize notification is returned as undeliverable or goes unanswered, the prize will be forfeited.
Sponsors disclaim all liabilities to winner with respect to use of their prize. Participants agree that Sponsors and their affiliated companies, and advertising and promotion agencies, and each of their respective officers, directors, employees, representatives, licensees, assignees and agents (collectively, the “Released Parties”) will have no liability whatsoever for, and are released and shall be held harmless by participants from and against any liability, for any injuries, losses or damages of any kind, to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or from participation in this Contest or in any Contest related activity.
Released Parties are not responsible for typographical, printing or other errors or problems relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the administration of this Contest, the processing of entries, the selection or announcement of the winner or in any Contest-related materials.
Copies of these Official Rules or a winner’s list may be obtained at WTWO/WAWV studios during regular business hours, at mywabashvalley.com or by mailing a written request along with a self-addressed stamped envelope to “Sweetest Kiss Photo Contest”, c/o WTWO/WAWV, 10849 N. US Highway 41, Farmersburg, IN 47850. Sponsors reserve the right to change these Official Rules at any time.
